Police have linked a pistol, which was found in the possession of a suspected criminal, and which they believe was used in a series of crimes, including an armed robbery at the Chaii Wali Café in Westlands, Nairobi, to Justice Aggrey Muchelule.
Mr Muchelule confirmed that the Beretta pistol of serial number H20930Y, belonged to him.
Who Is Aggrey Muchelule?
Justice Aggrey Otsyula Muchelule is a prominent Kenyan jurist who serves as a Judge of the Court of Appeal and was sworn in as the Principal Judge of the COMESA Court of Justice in May 2026.
He joined the Kenyan judiciary in 1982 as a District Magistrate and rose to become a Chief Magistrate. He was appointed as a High Court Judge in 2009, where he notably served as the presiding judge of the Family Division at the Milimani Law Courts.
He holds both Bachelor of Laws (LLB) and Master of Laws (LLM) degrees from the University of Nairobi, as well as a Diploma in Law from the Kenya School of Law.
Throughout his career, Justice Muchelule has been a strong advocate for alternative dispute resolution, particularly utilizing mediation to solve family succession disputes and unlock billions of shillings tied up in court cases.
The Firearm Puzzle
Justice Muchelule reported the loss of his licenced firearm after it was allegedly recovered from a suspected criminal who was gunned down in Joska, Machakos County, on July 13, 2026.
He reported that on Tuesday, July 14, he received a telephone call informing him that his Beretta pistol had been recovered in Joska while in the procession of a suspected criminal.
In a police report filed at Spring Valley Police Station, Justice Muchelule stated that on Tuesday, July 14, he received a call informing him that his Beretta pistol had been recovered in Joska while in the possession of a slain robbery suspect.
Following the call, he headed to his residence in New Kitisuru, Nairobi, where he had allegedly stored the firearm, and discovered that it was missing.
Justice Muchelule stated that he was unaware the firearm was missing until investigators contacted him about its recovery.
The judge then proceeded to the station to report the disappearance, triggering an investigation into the circumstances under which it went missing and to verify claims of its alleged recovery.
“This call prompted him to go and check for his firearm at his residence, where he had kept it sometimes back, but he discovered that it was missing. He stated that he does not usually carry the firearm. He further stated that the last time he physically checked it was in October 2025, when he intended to renew his firearm licence. However, he later forgot to complete the renewal process,” the police report filed under OB NO. 58/14/07/2026 adds.
The pistol, with fifteen (15) rounds of 9mm ammunition, was recovered following a fatal shootout with a violent robbery suspect, Vincent Ochieng, at his rented house in Joska.
Ochieng was killed in a fierce exchange of fire with the police, leaving behind the loaded firearm and several mobile phones.
According to detectives, the firearm was used by Ochieng and his accomplices to stage several robberies, including the one at the Chaiiwali restaurant along General Mathenge Road in Spring Valley, Westlands, on July 4.
During the robbery incident, masked gunmen stormed the hotel and terrorised customers in a viral moment that was captured on CCTV.
According to the police account, the judge says the last time he physically checked the weapon was in October 2025, when he intended to renew his firearm licence, but he later forgot to complete the renewal process.
