After the impeachment of Deputy President Rigathi Gachagua by the Senate on Thursday 17th October, President William Ruto appointed CS Kithure Kindiki as the Deputy President, a few hours later, in the morning of Friday 18th.
The National Assembly, led by Moses Wetangula, held a special sitting and voted unanimously to approve Mr Kindiki.

However, Gachagua’s legal team moved to court, seeking to overturn the impeachment of Rigathi. Orders from two courts, prohibiting the replacement of Gachagua and implementation of The Senate’s resolution were issued.

As preparations for Kindiki’s swearing-in were underway, President William Ruto’s economic adviser, Moses Kuria alleged that Kindiki would take oath of office as early as Saturday, 19th October.
“Kindiki will be sworn in on Saturday at Uhuru Gardens,” Kuria alleged.

The CS further rubbished The court’s conduct in considering Gachagua’s petitions.
“I don’t understand why Kenyan courts won’t exercise judicial restraint and stay out of purely political disputes. Gachagua is politicaly dead. Nothing can revive him, even the Supreme court, let’s stop this tomfoolery. The new DP is Kithure Kindiki,” said Kuria.
Gachagua’s lawyers in the meantime issued a statement that Gachagua is the sitting Deputy President untill Tuesday 24th, when the court will decide on the way forward.
The historic moment left Kenyans in questions as there appeared to be an unusual process.
lawyer Nelson Havi expressed his worries on the decisions made by the National Assembly by approving Kithure Kindiki before the courts cleared Gachagua’s petitions.

“A constitutional crisis of two Deputy Presidents in office. Well done, Parliament,” Havi cautioned.
